In an unprecedented raid Friday, local law enforcement seized computers, cellphones and reporting materials from the Marion County Record office, the newspaper’s reporters, and the publisher’s home.
Eric Meyer, owner and publisher of the newspaper, said police were motivated by a confidential source who leaked sensitive documents to the newspaper, and the message was clear: “Mind your own business or we’re going to step on you.”
The city’s entire five-officer police force and two sheriff’s deputies took “everything we have,” Meyer said, and it wasn’t clear how the newspaper staff would take the weekly publication to press Tuesday night.
The raid followed news stories about a restaurant owner who kicked reporters out of a meeting last week with U.S. Rep. Jake LaTurner, and revelations about the restaurant owner’s lack of a driver’s license and conviction for drunken driving.
Meyer said he had never heard of police raiding a newspaper office during his 20 years at the Milwaukee Journal or 26 years teaching journalism at the University of Illinois.
“It’s going to have a chilling effect on us even tackling issues,” Meyer said, as well as “a chilling effect on people giving us information.”

U.S. Small Kansas newspaper says co-owner, 98, collapsed and died after police raid BY ALIZA CHASAN

Joan Meyer, the 98-year-old co-owner of a small Kansas newspaper, collapsed and died at her home on Saturday, a day after police raided her home and the Marion County Record's office, the newspaper said. Meyer had been "stressed beyond her limits and overwhelmed by hours of shock and grief," the Record said, calling the raids illegal.
Marion Police Chief Gideon Cody on Saturday defended the raid and said that once all the information is available, "the judicial system that is being questioned will be vindicated." Police have not shared an update since Meyer's death was announced.
Police took Meyer's computer and a router used by an Alexa smart speaker during the raid at her home, according to the paper. Officers at the Record's office seized personal cellphones, computers, the newspaper's file server and other equipment. Cody also allegedly forcibly grabbed reporter Deb Gruver's cellphone, injuring a finger that had previously been dislocated.
"Our first priority is to be able to publish next week," publisher Eric Meyer said. "But we also want to make sure no other news organization is ever exposed to the Gestapo tactics we witnessed today. We will be seeking the maximum sanctions possible under law."

What has remained unreported until now is that, prior to the raids, the newspaper had been actively investigating Gideon Cody, Chief of Police for the city of Marion. They’d received multiple tips alleging he’d retired from his previous job to avoid demotion and punishment over alleged sexual misconduct charges.

Police had "insufficient evidence" to raid the offices of a small Kansas newspaper — and seized belongings should be returned immediately, officials said Wednesday.

"Upon further review, however, I have come to the conclusion that insufficient evidence exists to establish a legally sufficient nexus between this alleged crime and the places searched and the items seized," Ensey [Marion County Attorney] said in a statement.
"As a result, I have submitted a proposed order asking the court to release the evidence seized. I have asked local law enforcement to return the material seized to the owners of the property."
A lawyer for the newspaper said he was working quickly to get back the seized items.
"Yes, I can confirm the county attorney has withdrawn the search warrant and the items seized are being released," the newspaper's attorney Bernie Rhodes said. "My forensic expert is en route to Marion to retrieve them."
Neither Marion Police Chief Gideon Cody or a representative of his agency could not be immediately reached for comment on Wednesday.

Marion County Record staff worked through the night to publish the paper’s weekly edition as scheduled Wednesday, days after police raided the newsroom and confiscated computers, cellphones and other items.
A single word screamed across the top of the paper in 200-point bold type — “SEIZED” — followed by a defiant statement: “… but not silenced.”
