As you know, I was hit by a car a month ago,, and am now dealing with insurance companies (both mine and the driver’s). Is anyone here knowledgeable about the behavior of insurance companies in these situations? I know I’m being vague here, but it would really help to talk to a party that is uninvolved. (I’m talking to a lawyer here, but she has her own interests.)

The car insurance laws as far as whose insurance pays for what vary WIDELY by state. So it probably won't help for anyone who is not in NY to respond.

For example, when I was in grad school in Ohio, I was still on my parents' PA insurance policy. I was hit by a woman from Ohio (with Ohio insurance). I was injured badly enough to merit a trip to the ER and the accident was deemed to be her fault. In PA, any medical bills are paid by each person's own insurance, no matter who is at fault for the accident. In Ohio, the medical bills are paid by the insurance of the person who is deemed to be at fault. So my PA insurance paid my medical bills and then like 2 months later, I got a check from her insurance for the amount of the medical bills. I questioned it, was told that's the way it was and the money was mine to keep, and I happily deposited the (to me at the time as a dirt poor grad student, rather huge!) check! But the laws in NY could be like PA's, like Ohio's, or something totally different so my experience won't help! Good luck getting it all sorted out though!

What Lisa said. It's all very state-driven. We've had to lodge claims twice that I can recall--once was our daughter's fault, the other happened to my son (not his fault). In our case the insurance company handled everything, including the second one, which occurred in Canada.

Thanks for responding. I finally remembered I have an in-law who is an insurance adjuster (though maritime, not auto) and he knows how the business works, so he filled me in quite well.

It's a collossal nuisance to deal with these insurance issues, but at least, you're there and able to do it.

But all this reminds me of the accident itself, and your injuries.

How's all that going? Hoping for good news about healing.

Thank you, Amanda. Doing quite well, now progressed from walker to a cane. Progressive exercises train more muscle groups; some push the envelope on pain (though I'm taking pain meds). Have had swollen feet for the past 2-3 weeks, and normally that's expected, though my right foot has gone down a lot. So will go in for an ultrasound Friday just to be careful about blood clots in the other (injured) leg.

Therapist is happy with my progress.
