A couple of days ago the question was posed next door about what new standard we’re operating under when it comes to filling SCOTUS vacancies. Do we leave them vacant if the President has one year left? Two years left?
My answer was that the new standard we’re operating under, in a de facto sense at least, is that
no vacancy will be filled, period, unless the Senate and President are of the same party.
I can see vacancies being filled in pairs through a compromise that doesn’t change the status quo ante, but even that would be hard if one party thought they’d have both the Senate and the Presidency in the near future.
Am I being too pessimistic?
