The SCOTUS would have had to take a much harder look if the vote had been 7-0 or 6-1. Without having read a single word of the majority decision, I think the SCOTUS is much freer to reverse this decision given the Colorado Court's obvious split. | |||

I guess the interesting issue is the reasoning of the Colorado court's dissenters. I'm hearing that much of the dissent was about Colorado law, which SCOTUS can't weigh in on. There are surely US Constitution issues, but the SCOTUS won't be able to rely substantially on the Colorado dissenters' views of the case. They'll have to do some of their own work! | |||

What are the consequences of ruling Trump off the ballot in a state he cannot win anyway? Not perfectly clear to me. Does Trump throw his weight behind the Kennedy creep? That might put Colorado in play, and would certainly embarrass the Dems if they have to work hard to avoid losing a state to Kennedy. There are other states considering this option, but I think they're mostly blue. Doing this could collapse Democratic turnout, costing the Dems dearly in down ballot races. | |||

Things are about to get even more interesting. I read where various red states, Notably Texas, will be removing Joe Biden from their ballot. I’d like to se how they justify this but I have little confidence that the current SCOTUS will object.

When Trump was impeached the second time for instigating the insurrection: After the vote was tallied, Senate Minority Leader Mitch McConnell took to the floor to brutally slam Trump for his actions. He declared that on January 6, 2021, “American citizens attacked their own government. They used terrorism to try to stop a specific piece of democratic business they did not like.” He then made it clear that Trump was to blame: “They did this because they had been fed wild falsehoods by the most powerful man on Earth – because he was angry he’d lost an election.”
