SCOTUS refuses to hear the suit brought by Rep Mike Kelly of PA.

Took a little over half hour to decide:

“The application for injunctive relief presented to Justice Alito and by him referred to the Court is denied.”

Not sure I understand this. That's an op-ed by Paul Campos, not a reply brief by the state of Pennsylvania.

Here's a link to what I am told is called a "reply brief" from the State of Pennsylvania.

It asks you to download a PDF.

I've never read one of these before. Is this one pretty typical?

Just when you thought things could not get any stranger, we have an amicus brief from two states that don't actually exist:

New California and New Nevada

quote:
The Supreme Court refused Friday to let Texas challenge the election results in four battleground states critical to President Donald Trump's defeat at the polls last month, likely sealing his political fate.

"Texas has not demonstrated a judicially cognizable interest in the manner in which another state conducts its elections," the court said in a brief order. It dismissed all other related claims as moot.

quote:
The court’s ruling was 7-2 that Texas has no standing to challenge the election outcomes in other states, a blow both for Trump and for Texas Attorney General Ken Paxton. Paxton co-chaired his “Lawyers for Trump” campaign effort and crafted the longshot lawsuit, which election law and constitutional experts viewed as an affront to democracy.

“The State of Texas’s motion for leave to file a bill of complaint is denied for lack of standing under Article III of the Constitution. Texas has not demonstrated a judicially cognizable interest in the manner in which another State conducts its elections. All other pending motions are dismissed as moot,” the court wrote in a brief unsigned ruling.

Two conservative justices, Samuel Alito and Clarence Thomas, dissented on grounds that since only the Supreme Court is empowered to handle controversies between states, the court had no option but to hear the case. They were careful not to say whether they believed it had merit, or whether the court has the authority to deliver the remedy Texas sought.

We all knew the suit was bonkers, we all knew than any honest practitioner of the law would throw it out, but there are a lot of things I thought I knew that have turned out not to be true.

Dodged a bullet? Maybe the system worked this time? Dunno. The behavior of much of congress in this matter has been a disgrace.

But it's a good decision and good news. ThumbsUp
