If I had to guess what will happen, I'd say that a suit is filed, a stay is issued in the lower courts, and the Supreme Court lifts the stay, and the wall gets built while the case is ongoing.

A lesser order possibility is that the Supreme Court decides the case on an emergency basis. If that happens, I'd bet they let him build the wall.

And an even lesser order possibility is that the Supreme Court says that he can't build the wall, and he decides not to listen to the Supreme Court. I think even Republicans would have to balk at that.

Takings are a different story. But, remember, the government has a right to take property, as long as there is "just compensation". So, Trump could argue that the taking is immediately valid, and the lawsuit is merely about the price to be paid. That might pass muster with five Justices.

I think the real impediment will be using military appropriations to build the wall. That could be illegal, but it also could upset the Military Industrial Complex, which owns a lot of senators.

Also, remember that $5 billion will only build 200 miles of wall. What about the other 1800 miles?

Well, the Cato institute has been running some numbers. 50B for the wall seems like a wild underestimate. Likely more than 100B.

The total of state appropriations for all of public higher education in 2017 is only 84B.
